NEW SUSTAINABILITY LEGISLATION

Declaration introduction.


The sustainability declaration,  passed through parliament , is due to be implemented on 1 January 2010,  
 

From 1 January 2010, sellers will be required to complete a sustainability form for their property prior to it being listed for sale.

A real estate agent will be unable to market a property for sale until this form is provided to them by the seller.

The declaration will summarise the energy, water, safety and access features of a house, unit or townhouse for prospective buyers and must be completed by a seller or third party prior to marketing the property for sale.

It is exciting that the government taken a step closer sustainability. This is a step in the right direction. There is an issue with the cost of the assessment. The financial burden on sellers. The obligation for completion rests with the seller of the property.

The State Government lack of consultation with the Real Estate Industry is disappointing. The REIQ have a very important role in promoting and encouraging environmental sustainability in Residential and Commercial property. Future consultation is paramount.
